By accessing or using Agiler’s web hosting services, you agree to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

You affirm that you are either more than 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service.

Service Description

Agiler provides serverless web hosting services, allowing users to deploy and run web applications without the need to manage underlying server infrastructure.

Our billing model is based on actual usage of computing resources, including but not limited to CPU time, memory usage, and data transfer.

User Responsibilities

You are responsible for maintaining the security of your account and password. Agiler cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

You agree not to use the Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our servers or networks.

You are solely responsible for the content hosted using our Services and ensure that it complies with all applicable laws and regulations.

Billing and Payment

Charges are calculated based on your actual usage of computing resources. This includes, but is not limited to, CPU time, memory allocation, and data transfer. If you purchase credits, we will apply available credits to your usage charges in the order incurred until the credits are depleted.

You remain responsible for any amounts not covered by credits. You authorize us to charge your designated payment method for any outstanding balance and acknowledge that we may suspend or terminate services for accounts with outstanding balances or insufficient credits.

We may change our prices at any time. We will provide you with at least 30 days’ notice of any price changes.

Credits

Credits are pre-paid amounts that may be used solely to offset fees and usage charges for the Services. Credits are not legal tender or stored value, have no cash equivalent, and are non-transferable. Credits are non-refundable except where required by law.

Credits may be subject to expiration or additional terms communicated at the time of purchase or in an applicable promotion. Promotional credits may include usage caps or scope restrictions and may be revoked if we suspect fraud, abuse, or misuse.

Credits do not include applicable taxes, duties, or third-party fees. You are responsible for any such amounts, which may be charged to your payment method or invoiced separately.

Service Limitations and Modifications

While we strive for high availability, the nature of our architecture means that there may be occasional service interruptions or downtime for maintenance or updates.

We may impose soft or hard limits on resource usage to ensure fair use of our platform. These limits may be adjusted at our discretion.

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice.

Termination

You may terminate your account at any time. You will be responsible for all charges incurred up to the point of termination.

We reserve the right to terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Intellectual Property

You retain all ownership rights to the content you host using our Services.

You grant Agiler a worldwide, non-exclusive license to host, use, modify, and display your content solely for the purpose of providing the Services to you.

Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis. Agiler makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Limitation of Liability

In no event shall Agiler, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Nevada, United States, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to update or change our Terms of Service at any time. We will provide notice of any material changes by posting the new Terms of Service on this page and updating the “last modified” date at the top of this page.
